DE: Devoted Events

1. DEFINITIONS
(a) ‘DE’ shall mean Devoted Events of 85 Writtle Road, Chelmsford, CM1 3BS
(b) ‘The Customer’ shall mean the customer named overleaf

2. OBLIGATIONS OF DE
Subject to the conditions hereinafter contained, DE shall provide a disc jockey and all equipment, lighting & music for the period of time agreed overleaf

3. PAYMENT
The Customer must pay the specified deposit on completion of the booking form or the full fee if the booking is made within 4 weeks of the date of the function. Advance payments can be made by cheque or BACS to Devoted Events. Sort Code 09-01-29, account number 06981143. The customer’s name and event date should be the payment transaction ID

4. CANCELLATION
If the Customer cancels after the booking is accepted for reasons associated with the Customer or the venue DE shall be entitled to make the following cancellation charges
(a) If more than 3 months before the date of the event – the deposit
(b) If 3 months or less but more than 1 month before the event – 50% of the overall fee
(c) If one month or less – 100% of the fee

5. WARRANTY OF SUITABILITY OF PREMISES
The Customer hereby warrants that the venue shall be suitable for the presentation of the discotheque in that there shall be a clear area of not less than 6 square metres and at least 2 ordinary mains plug sockets in good working order

6. FORCE MAJEURE
DE shall not be liable for any loss, damage, injury or delay due to any cause beyond its control including (without prejudice to the generality of the foregoing expression) acts of government, strikes, lockouts, fire, lightning, aircraft, explosion, flooding, riots, civil commotions, acts of war, malicious mischief or theft

7. VARIATION
Neither DE nor the Customer shall be bound by any variation, waiver of or addition to these conditions except as agreed by both parties in writing and signed by them

8. LIMITATION
DE shall not be liable to the Customer for loss or damage suffered by the customer unless due to the negligence or other failure of DE to perform its obligations under this agreement or general law and in respect of which liability is limited to the amount of the booking fee

9. INSURANCES
DE warrants that all equipment used that is not under existing manufacturer warranty will be fully PAT tested and public liability insurance will be in force with an indemnity value up to £10,000,000

10. DAMAGE INDEMNITY
The customer warrants that damage-causing financial loss to DE, whether willful or due to the negligence of themselves or their guests, will be reimbursed by the customer to effect necessary repairs.
